Workers’ Compensation Benefits for Public Workers and Government Employees

Government employees have workers’ compensation benefits provided by their employer, whether they work for a local school system, a municipal or county government such as the City of Charleston or Charleston County government, a hospital, a correctional facility or a state agency such as the S.C. Department of Transportation.  Federal government employees are not covered the South Carolina Workers’ Compensation Act.

As a government employee, you are covered if you suffer an injury while performing job-related duties or develop a disease caused by your job duties. You also may be covered while traveling to and from work if your transportation is provided by the employer, or if you were carrying out a job duty while traveling

The South Carolina State Accident Fund administers workers’ compensation claims for non-federal government employees in South Carolina. The State Accident Fund, a state agency, functions as an insurance company for 700 government employers, providing workers’ compensation coverage to 200,000 public workers.

If you are injured on the job, you should report the injury promptly to your employer. Depending on the nature of your injury, you may be eligible for coverage for medical treatment, temporary disability income and permanent disability/disfigurement compensation. The State Accident Fund will determine your benefits after receiving a completed WCC Form 12-A from your employer.

If you, your employer and the SC State Accident Fund cannot agree on the payment of benefits, you may request a hearing by the South Carolina Workers’ Compensation Commission, which administers the workers’ compensation law. You do not have to have a workers’ compensation attorney represent you during the hearing — but it’s certainly a good idea to have legal representation.
